First, read the warranty. Make sure the warranty covers headphones and not just the Nano. It should also tell you how to file a warranty claim.
If reading the warranty information is not possible… yea… right… like we all keep the warranty card… then go by your nearest Apple store. Remember to bring your headphones and the Nano, as well a the receipt (even if you did not buy it from Apple directly; it is for proof of purchase)
Third, if you do not live within a reasonable distance from a Apple store you can call them, or go to their website. Apple has a great support section online.
